SUBJECT: Refueling of Powered Industrial Trucks and Equipment
CHANGE TYPE: Modification
309.5 Refueling. Powered industrial trucks using
liquid fuel or LP-gas shall be refueled outside of
buildings or in areas specifically approved for that
purpose. Fixed fuel-dispensing equipment and
associated fueling operations shall be and in accordance
with Chapter 22. Other fuel-dispensing
equipment and operations, including cylinder exchange
for LP-gas fueled vehicles, shall be in accordance
with Chapter 34 for flammable and
combustible liquids or Chapter 38 for LP-gas.

CHANGE SIGNIFICANCE: This section in the 2003 International Fire Code implied that filling of forklifts and other powered industrial
trucks was not “dispensing of fuel into the tank
of a motor vehicle,” which is the trigger for an operation
to be regarded as a motor fuel-dispensing operation
governed by Chapter 22 when fixed equipment is
involved. The revised text makes the application of this
section clear, requiring compliance with Chapter 22
when fixed equipment is involved. Compliance with
Chapter 34 is required for use of portable fueling equipment
for flammable and combustible liquid fuels and
Chapter 38 for exchange of fuel cylinders containing
liquefied petroleum (LP) gas.
