On Nov. 3, ICC announced the procedures to address the 2015 Group A Public Comment Hearing (PCH) voting problems with the electronic voting devices. The two-step electronic voting process is intended to closely mirror the process used to conduct the in-person Public Comment Hearing (PCH), resulting in accurate and transparent PCH results to be used to conduct the Online Governmental Consensus Vote (OGCV). As noted in the announcement, eligible voting members will be limited to those who were issued an electronic voting device during the PCH in Long Beach, Calif. cdpACCESS will transfer the recorded voting results for those who voted in Long Beach. The voter is not permitted to change their vote. For eligible voters who may have voted, and the vote was not recorded by the voting system, or for those who did not vote, they will be permitted to vote online.
The two-step electronic voting process only applies to code changes for the following codes, in PCH hearing order: International Swimming Pool and Spa Code (ISPSC), International Fuel Gas Code (IFGC), International Plumbing Code (IPC), International Residential Code (IRC) — Plumbing, IRC — Mechanical, International Mechanical Code (IMC), International Property Maintenance Code (IPMC), International Existing Building Code (IEBC), International Building Code (IBC) — Egress and IBC — Fire Safety code changes FS 1 through FS 63. The PCH action on the remainder of the IBC — Fire Safety, IBC — Structural (heard by IBC — General) and IBC — General code changes was determined by the Moderator and as such, these code changes will go directly to the OGCV based on the action taken.
In accordance with CP 28 procedures for conducting the PCH, the first step in the electronic voting process will be the vote to sustain the committee action (or eligible public comments depending on the committee action) from the 2015 Committee Action Hearing. This is scheduled to start on Jan. 18, 2016, and be open for seven days.
Following the first step, the results will be audited by ICC's third-party auditors. The results from step one will determine the allowable motions to be considered in step two, which is scheduled to start on Jan. 28, 2016. The length of time the voting period is open will be dependent on the number of code changes to be considered.
Following step two, the results will be audited and the results of the two step online PCH will be posted. These results, combined with the Long Beach PCH results for those code change actions determined by the Moderator, will be the basis to conduct the OGCV in accordance with Section 8.0 of CP 28. The OGCV is scheduled for Feb. 8-21.
